A) Terms and conditions BPM-Lux
Particular Conditions
This BPM Box Service Agreement ("Agreement") is made and entered into by the customer identified and registered via BPM-Lux for the use of and services related to a BPM Box at BPM-Lux (a service of RT-Log S.A.), (BPM-Lux) under the terms set forth herein
REPRESENTATIONS AND WARRANTIES
BPM-Lux is the sole owner of the Mailboxes (BPM-Boxes) located in Luxembourg and provides the customer with a Mailbox ( BPM-Box ) Number, located at a street address in Luxembourg .
General Conditions
1) Customer's Box Access.
Customer will receive from BPM-Lux one magnetic chip and one key. This will allow the customer 24 hours per day 7 days per week secure access to his BPM-Box.
In case of loss of the magnetic chip and/or key, customer must immediately inform BPM-Lux via written notice to cancel access of this magnetic chip to the BPM-Lux secure area.
BPM-Lux provides free parking area 24 hours per day 7 days per week during the required pick up time of approximately 15-30 minutes.
Wrongly routed mail can be returned by customers immediately after pick up, by placing envelopes in the special box at the reception desk marked BPM Mail Return.
If the Customer is a Company, this will retain its Administrative and registered address. The agreement covered herewith is not a domiciliation agreement. BPM-Lux will not act as a domiciliary agent.
BPM-Lux does not act as the Customer's representative or agent, its exclusive task is to perform the services agreed to herein.
2) Conditions to use Customer's Box.
2.a.)Customer agrees that Customer will not use the BPM-Lux premises or any BPM-Lux services for any unlawful, illegitimate or fraudulent purpose or for any purpose prohibited by European Community Law, Luxembourg postal regulations, and/or IATA restrictions. Customer further agrees that any use of the BPM-Box shall be in conformity with all applicable European, origin country, as well as local and destination country laws.
2.b.) Customer agrees to provide additional information and personal ID's if requested by BPM-Lux.
2.c.) Students using the UNI7876 registration code applying for reduced rates will provide additionally a copy of ID and yearly School / College or University valid certificate about their student status.
Student rates apply for students between 18 – 30 years old ( age at date of registration ) providing copy of ID and yearly School / College or University valid certificate about their student status. Once student status finishes, BPM will maintain the student rate for additional 12 months. 12 months after finishing his studies, customer agrees to pay the full published rates with his contract renewal. The BPM Box number will remain the same with contract renewal.
3) Mail Contents.
BPM-Lux reserves the right to check mail for unauthorized and unlawful contents, in cooperation with local authorities by means of scanning by means of X-ray and or drug searching dogs.
4) Authorizations.
Each individual or entity (Customers) authorizes herewith BPM-Lux to receive any mail, packages, express and certified letters at the BPM-Box, showing a valid BPM-Box number and/or Customer's name on the Consignee address of the letter.
5) Non Disclosure.
This Agreement shall remain confidential, except that this Agreement may be disclosed upon written request of any law enforcement or other governmental agency, or when legally mandated. Upon request, Customer agrees to complete all necessary documents, and any required acknowledgment form relating to service of process. Customer further agrees to accept every updated version published in the BPM-Lux Web page.
6) Box Key Possession.
Possession of the BPM-Box key and access control chip shall be considered valid evidence that the possessor is duly authorized to remove any contents from the BPM-Box. In the event of death or incapacity of Customer, BPM-Lux will require the appropriate documents from the Court, the executor of the estate, the trustee or other similar person or entity before releasing mail or packages to a requesting party.
7) BPM Services Payment. Customer agrees to pay applicable yearly or monthly service fees in advance.
Customer authorizes BPM-Lux to charge his/her credit card for renting Dues, Shipping and Handling Charges, and charges for any Additional / Optional Services selected by the Customer.
BPM-Box service fees are all due and payable in advance and Customer agrees that BPM-Lux may hold mail and packages pending payment. In the case of cancellation of any service Refund will be Management discretion, and after deduction of service performed and unpaid. In the event the BPM-Box lock is changed upon the request or fault of Customer, Customer agrees to pay a fee of €20. BPM-Box service fees and other related fees stated herein are subject to change.
In the event that Customer receives an unreasonable volume of mail or packages at BPM-Box according to the BPM-Lux reasonable judgment, BPM-Lux may require Customer to upgrade to a larger size BPM-Box and pay any additional charge, or accept that BPM-Lux forward to the last by the customer updated physical address, at his cost. This and any extra service cost will be deducted from the credit card account given by the customer. BPM-Lux reserves the right to increase the BPM-Box service fees in the event that Customer adds additional individuals or entities to the names of those individuals or entities authorized to receive mail and packages at the BPM-Box originally covered by this agreement.
8) Alternatives upon the termination of the Agreement.
Upon expiration, cancellation or termination of this Agreement, BPM-Lux will.:
A) Provide the Customer with the following procedural alternatives.:
a.1. Forward Customer's mail for three (3) months, provided Customer pays the postage, packaging material, and forwarding fees in advance.
a.2. Immediate cancellation: all arriving mail, packages etc. will be refused by BPM-Lux street address, and return to sender as address unknown.
B) BPM-Lux will inform one month in advance by Email to the customer of the expiration of the agreement. If no other advice is received the agreement will be automatically prolonged, and BPM-Lux will be authorized to debit Customer's credit card account.
C) It is the Customer's responsibility to make arrangements with BPM-Lux to identify any mail forwarding needs prior to the expiration, cancellation or termination of this Agreement.
D) Upon expiration of this agreement and if the Customer leaves no forwarding fees prepaid and forwarding address, BPM-Lux may return to sender as address unknown on a COD basis. If sender denies reception BPM-Lux may discard or destroy any mail or package.
E) After contract expiration, discard or destroy any "Unsolicited Mail" (e.g., bulk mail; mail addressed as "occupant," "current resident" or similar designation; or coupons, advertising or other promotional material) delivered to or remaining at BPM-Lux.
F) After contract expiration refuse any package and post addressed to Customer, delivered by P&T or any other postal service or any party or other express, courier or parcel service company and return to sender as address unknown.
9) BPM Lux's Rights after expiration. Based on article 8.a., after the expiration, cancellation or termination of this Agreement, BPM-Lux may:
a.) Terminated BPM-Box numbers become available for assignment to new customers immediately.
b.) Delete access to BPM-Lux via magnetic chip card.
10) Term of the Agreement.
The term of this Agreement shall be the initial period selected by Customer and any renewal period paid for by Customer from time to time.
11) Termination of the Agreement in advance.
The customer can cancel this agreement after a minimum contractual period of one month, on a monthly basis.
Written notice will be sent by e-mail and/or postal mail to BPM-Lux before the 30 th of the month the agreement to be cancelled.
Customer agrees that BPM-Lux may terminate or cancel this agreement for good cause at any time by providing customer thirty (30) days written notice. Written notice will be sent by e-mail and/or postal mail to the customer's last given address.
Good cause shall include but is not limited to:
A) Customer abandons the BPM-Box.
B) Customer uses the BPM-Box for unlawful, illegitimate or fraudulent purposes.
C) Customer fails to pay monies owed to BPM-Lux.- when due. BPM-Box is to be paid in advance.
D) Customer receives an unreasonable volume of mail or packages, not previously agreed with BPM-Lux, and does not respond to the solutions proposed by BPM-Lux.
E) Customer engages in offensive, abusive or disruptive behavior toward other customers of BPM-Lux or BPM-Lux's employees.
F) Customer violates any provision of this Agreement. Customer acknowledges that, for the purpose of determining good cause for termination of this Agreement as provided herein, the actions of any person authorized by Customer to use the BPM-Box will be attributed to Customer.
G) Customer does not update his credit card information on the expiration of existing credit card.
H) Customer cancels BPM-Lux authorization to deduct additional service charges from his credit card account.
12) Notifications.
Any written notice to Customer required or permitted under this Agreement shall be sent by e-mail and/or postal mail to the last, by the customer, in his secure administration area given address.
13) Reception of mail.
As Customer's authorized agent for receipt of mail, BPM-Lux will accept all mail, including registered, insured and certified items. Customer must accept and sign for all mail and packages upon the request of BPM-Lux.
A) Parcels will be stored in special BPM-Parcel boxes:
(Max dimensions 40 cm x 31 cm x 40 cm.).
Packages stored in separate BPM-Parcel boxes ( Max dimensions 40 cm x 31 cm x 40 cm ) not picked up within 14 days of notification will be subject to a storage fee of € 2 per day per parcel-locker, which will be deducted from the credit card account given by the customer. After 60 days of receipt packages will be forwarded to the last given address at customer's expense. These charges will be deducted from the credit card account given by the customer.
In the event that Customer receives an unreasonable volume of mail or packages at BPM-Box according to the BPM-Lux reasonable judgment, BPM-Lux may require Customer to upgrade to a larger size BPM-Box and pay any additional charge, or accept that BPM-Lux forward to the last by the customer updated physical address, at his cost. This and any extra service cost will be deducted from the credit card account given by the customer. BPM-Lux reserves the right to increase the BPM-Box service fees in the event that Customer adds additional individuals or entities to the names of those individuals or entities authorized to receive mail and packages at the BPM-Box originally covered by this agreement.
If customers receives large amounts of parcels on a regular basis, BPM-Lux will propose a special agreement, which will provide logistical support to handle the planned volume, store, pick unpack, forward etc.
B) Oversize Parcels:
Bigger than …40 cm x 31 cm x 40 cm .
Packages which are bigger than the BPM-Parcel boxes provided by BPM-Lux, can be picked up at the same site, next door to BPM-Lux, between 6:00 am and 10:00 pm from Monday to Friday and between 7am to 7 pm on Saturdays. Opening hours can be changed without previous advice and will be published on the Web page regularly. Customer will be notified by e-mail and will find a pick up document which must be presented at the Customers Pick up door.
Oversize Parcels not picked up within 14 days of notification will be subject to a storage fee of € 2 per m3 per week, which will be deducted from the credit card account given by the customer. After 60 days of receipt packages will be forwarded to the last given address at customer's expense. These charges will be deducted from the credit card account given by the customer. If you need regular service of this kind please contact our Logistics dept.
C) C.O.D.( Collect on delivery ) Parcel with COD amounts can not be accepted.
D) Customs or nationalization fees, will be accepted ONLY if prior arrangements have been made, and charges have been deducted in advance from the Customer's credit card. A service charge of € 60 will apply by case, plus 5 % on the Taxes and VAT to be paid, if Customs Formalities have to be organized by BPM-Lux..
14) Indemnity.
Customer agrees to protect, indemnify, defend and safeguard BPM-Lux , RT-Log SA and their respective affiliates, subsidiaries, parent corporations, franchisees, officers, directors, agents and employees from and against any and all losses, damages, expenses, claims, demands, liabilities, judgments, settlement amounts, costs and causes of action of every type and character arising out of or in connection with the use or possession of the BPM-Box, including without limitation, any demands, claims and causes of action for personal injury or property damage arising from such use or possession, from failure of the P&T or any commercial courier service to deliver on time or otherwise deliver any items (mail, packages, etc.), from damage to or loss of any package or mail, or to the BPM-Box contents by any cause whatsoever, and from any violation by Customer of applicable Luxembourg or European laws.
15) Liability.
BPM-Lux accepts no legal responsibility or liability for the handling or forwarding of any mail on the Customer's behalf (whether unregistered, registered, certified or insured), or for any action, event or expense associated with or arising from the handling or forwarding of that mail.
Customer herein agrees that the total amount of liability of BPM-Lux , if any, for any and all claims arising out of or related to this agreement shall not exceed € 100.00 regardless of the nature of the claim.
16) Use of BPM Box's Address.
Customer must use the exact mailing address for the BPM-Box. BPM-Lux will not accept and return mail without a proper address to the endorsed sender.
"Undeliverable as Addressed."
Delivery by commercial courier services must be made to BPM-Lux street address only.
Customer makes sure that mail is addressed correctly as follows :

17) Operational duties
The Customer is obliged to accept stamps and notes on envelopes and documents where operationally necessary.
18) Mail Forwarding.
Forwarding of Mail and Parcels will be expedited via recognized courier operators at advantage rates for the customer.
Forwarding rates may vary depending on destination, courier service as well as fuel surcharge applied.
A) Customer will accept signature on an electronic device as proof of delivery.
B) Forwarded Documents which cannot be delivered by the selected carrier, will be returned to BPM-Lux. If the cause is an incorrect or invalid address given by the customer charges will be paid by the customer.
C) Where carriage by air involves a final destination or intermediate stopping point outside the country of origin International Air Conventions may apply. (For the purpose of these terms the phrase International Air Conventions mean (i) the Convention for the Unification of Certain Rules Relating to International Carriage by Air, dated 28.May 1999 (Montreal Convention) or (ii) the convention about Unification of Certain rules relating to Air freight, signed at Warsaw on 12th October 1929 or (iii) that Convention as amended or supplemented by any protocol or supplementary convention or (iv) any other international convention replacing or prevailing over any of the foregoing.)
Further, international carriage may be subject to the provisions of the Convention on the Contract for the International Carriage of Goods by Road signed at Geneva on 19th May 1956 ("CMR"). The International Air Conventions and the CMR Convention govern and limit the liability of carriers in respect of loss, damage or delay to cargo.
Liability for loss or damage is limited to proven direct losses to a maximum of € 100 per shipment or € 10 per kilogram, whichever is greater.
The carrier does not accept responsibility for indirect damage and consequential loss such as purely economic losses, loss of profits, loss of business opportunities or loss of sales, and expenditure on alternative provisions.
Any liability of the carrier for damages resulting from X-ray scanning is excluded.
The carrier is not liable for damage or loss where this results from defects in the packaging used by the customer or his supplier, or for damage to or loss of the packaging. BPM-Lux will offer packaging services at Customer's cost whenever poor packing is externally evident.
A shipment will only be regarded as lost if it has not been found within 40 days of the date forwarding took place.
D) Forwarding liability of BPM-Lux will be limited to the liability provided by their partners and carriers contracted for this service.
E) Rates are subject to change without previous notice and do not include customs or nationalization fees, which, if incurred, must be cancelled at the time of delivery of your merchandise
F) BPM-Lux designated carrier reserves the right, but is not obliged, to open and inspect packages in accordance with applicable laws or scan by means of X-ray any package tendered to it for transportation. X-ray, even when properly used, may cause damage to radiation sensitive goods.
G) Customs Clearance
G.1 Where a package requires customs clearance, it is the Customer's responsibility to provide complete and accurate documentation. BPM-Lux is acting in the name and by the order of the Customer. BPM-Lux designated carrier ( carrier ) will unless instructed otherwise act as the Customer's agent in obtaining customs clearance. The Customer also agrees that the carrier may be considered as being the receiver of the package for the sole purpose of appointing a customs broker to carry out any customs clearance. In principle, the carrier will not take responsibility for any customs clearance for shipments within the EU or within a customs area unless the carrier is given a separate instruction to do so.
G.2 If any duties, taxes, penalties, storage charges or other expenses are imposed or incurred as a result of any action by the customs authorities or as a result of any failure by the Customer or the receiver to provide correct documentation or any permits or licences required in connection with carriage, the receiver will initially be charged by the carrier with payment and, if the carrier cannot collect payment from the receiver on first request, it will be the Customer's responsibility to pay the amount in question to BPM-Lux, in which case BPM-Lux will deduct the amounts from the credit card account declared by the customer.
H.1 The carrier is not liable for interruptions or disturbances to its services due to circumstances that are not the sole responsibility of the carrier.
H.2 Examples of events falling within H.1 are disruption to air or ground transportation (e.g. due to particular weather conditions), fire and flood, war, hostilities and civil disturbances, acts of government or other authorities and labour disputes or obligations (whether affecting BPM-Lux, the carrier, its agents, subcontractors or third parties).
19) Services. BPM 7 Category.
Customers who have selected this service category, expressly authorize BM-Lux to open their mail, scan it, and upload to the BPM-Web server. Customer has access to his BPM-E-Box located on a secure Web server through his exclusive Login and Password.
Customer has access to his electronic document for 60 days after receipt. After this period of time, scanned document will be deleted from the web server automatically.
Customer may select following options after scanning.:
a) Pick up himself at the BPM-Box.
b) Forwarding.: in such case Customer will select daily, weekly or monthly forwarding.
c) Destruction.: BM-Lux will physically store the received and scanned original documents for 60 days, or shred them inmediatelly if customer give this instruction by special written notice. During this time the customer may ask for originals to be forwarded, if necessary.
After 60 days, documents will be automatically and without further notification shredded under Level 6 security conditions.
d) Storage.: By this selection Customer signs a storage agreement with BPM-Lux for one year. After that customer instructs BPM-Lux for further storage periods or destruction of the documents . In case of destruction docs will be shredded under level 6 security conditions.
BPM-Lux's Liability is limited to the value of the paper. In any case BPM-Lux will be liable for indirect damage and consequential loss such as purely economic losses, loss of profits, loss of business opportunities or loss of sales, and expenditure on alternative provisions.
20) Secrecy and non disclosure
The staff of the company is under written commitment and contractual obligation to handle the client's instructions, messages, phone calls, faxes and mail with the utmost secrecy and not to disclose any client-related information to a third party.
Each staff member of BPM-Lux is checked by local authorities and instructed about data security and postal privacy.
All staff members must provide a faultless certificate of good conduct from the police, before taking up employment.
21) SMS = Short Message Service
BPM 5 and BPM 7 package includes an SMS service which is provided by local Mobile Phone Companies and their agents in the countries of destination. BPM-Lux will not take any liability in the case that this SMS does not arrive at destination whatever the reason.
22) We reserve the right, at our sole discretion, to change, modify, or otherwise alter these terms and conditions at anytime.
Please review the terms and conditions periodically. Your continued use of site following the postings of changes and/or modifications will constitute your acceptance of the revised terms and conditions.
23) Responsibility for illegal activities.
Illegal activity (as determined by Luxembourg and European laws) is not permitted by BPM-Lux. Any legal fees incurred by BPM-Lux enforcing the applicable laws against a customer or potential customer will be the financial responsibility of the Customer.
24) Web-Server Service.
Customer expressly agrees that the use of the Web-server service is at Customer's sole risk. The Web-server service is provided on an “As it is” and “as available” basis. BPM-Lux makes no guarantee that the Web-server service will meet user's requirements, that the Web-server service will be uninterrupted, timely, secure, or error free. Customer understands and agrees that any material and/or data downloaded or otherwise obtained through the use of or from BPM-Lux Website and Web server is done at Customer's own discretion and risk and that Customer will be solely responsible for any damage resulting to Customer's computer system or loss of data that results from the download of such material and/or data.
25) Applicable Law and Competent Jurisdiction
The present agreement is subject to the law of Luxembourg .
Any litigation relating to the interpretation or the execution of the present agreement will be subject to the Courts of the City of Luxembourg .

B) Terms and conditions BPM-Shop
BPM Shop wants to bring the global markets closer to you, so that the interesting products and services on offer in countries that are currently online are conveniently available to you from your living room, without having to make a journey.
In addition to this, you do not get points, instead you get cash back amounts, which are shown next to each online shop you find as percentages or as lump sums. You decide how to use your credit and when you would like it to be paid to you (starting from a minimum figure of € 15).
Under no circumstances are your shopping preferences or personal data stored for the purposes of determining demographic data or any interests you may have.

BPM Shop, a service provided by RT-Log SA, is a cash back program that gives its registered members throughout the world the opportunity to purchase globally and thus save money.
The percentages or lump sums specified next to each online shop are credited to the membership account of the individual member.
1 Conclusion of contract
By registering, the member accepts the following BPM Shop contract terms ( BPM Shop is a service provided by RT-Log SA ).

Registration in product category BPM 11 ( BPM Shop ) is free. Percentages or lump sums are reimbursed, depending on which online shop you placed the order.
Charges are only incurred if the member upgrades to categories
BPM 1 – BPM 3 – BPM 5 – BPM 7 or BPM 9, or utilises other BPM Lux services.
2) Contract period
Membership of BPM 11 lasts for one year and is renewable annually. Membership is free in the first year and in all subsequent years.
Membership of BPM 11 can be cancelled at any time, free of charge.
After cancellation, the accumulated amounts are refunded to the bank account specified when registering, after the deduction of any charges that may be due for category BPM 1, 3, 5, 7 or 9 services or other BPM Lux services that have been utilised.
BPM 1 – BPM 9 contracts can be cancelled monthly without charge.
Following cancellation, the contract and the membership are only terminated once BPM Shop has refunded the member or the member has paid any outstanding amounts to BPM Lux.

4 Customer obligations
a) When registering, the customer undertakes to provide full and accurate information, both with regard to fact and content.
b) BPM Shop is entitled to check the data supplied.
c) The customer must update their profile at regular intervals.
d) The customer must ensure that the bank details provided in their profile are always up-to-date, so that repayments can be made without difficulty and without charge.
The customer must regularly update the e-mail address specified in their profile, to ensure that communications sent by the BPM Shop are received.
e) Citizens throughout the world who are at least 18 years of age or older on the date they register are eligible to be members. (The legal interpretation of the category of adult can differ from country to country. The customer undertakes to comply with the law of the country in which they reside and to respect the stipulated age limit in their country).
f) People are eligible for membership.
Machines, scripts, or automatic direct debit systems must not be online or logged in to the BPM Shop Cash Back program.
g) The BPM Shop Cash Back program can only be used over the Internet. The customer must have Internet access available. BPM Shop is not responsible for the Internet access and is not legally liable for it.
h) It is the responsibility of the member to check the posted credit at regular intervals and to request that payments are made. Should you think that reimbursements have not been paid on any purchases, once you inform us of this fact, we will check it to the best of our ability. Although it is certainly true that electronic links may contain errors. Should it not prove possible to trace the purchase, BPM Shop cannot be made liable for the missing credits.
5 Participation in the Cash Back program at BPM-Shop.com
Once the minimum figure of € 15 is reached, the sums accumulated in the member account can be paid on instruction by the member. This instruction is given electronically in the My Account area of BPM-Shop.com by entering your login and password. No interest is paid on the credit balance.
Payments are made to the accounts specified by the members. BPM Shop always uses the method of transfer that is best for both parties. The member is responsible for paying any bank charges that may arise.
The amounts resulting from the Cash Back program are credited to the member’s account no later than sixty days after the purchase has been made.
Should the customer also utilise the services of BPM Lux, the amounts due will be offset with the credit and the balances will be transferred.
The timeframe for this is agreed with the competent clearing house and aims to take into account any returns or payments the member may make to the online shop, before making reimbursement. Under no circumstances will the member’s account be reimbursed without approval from the online shop and the competent clearing house.
The Cash Back program can only be managed and utilised by the member if they proceed as follows each time they make a purchase:
D) Online access to BPM Shop.
E) Log in with their membership number and password.
F) Purchases are made during this login session. Should the customer
log off and then make their purchases via a direct login to the online shop, there is no reimbursement to BPM Shop and the Cash Back program can neither be managed nor respected. In this situation, no reimbursement can be forwarded to the customer.
D) Participation in the Cash Back program can only occur once the customer has received the goods at the required delivery address and the invoice from the online shop has been settled. Returns or unpaid invoices do not qualify for participation in the Cash Back program.
Where there is misuse, BPM-Shop.com reserves the right to cancel individual reimbursements or the entire Cash Back program and the membership. This also applies to reimbursements that have already been paid.
6 ) Terms of contract and conclusion of sale between the customer and the online shop
A) The contractual relationship is always directly between the BPM Shop customer and the online shop. The general terms and conditions of business of the relevant online shop are applicable to both parties.
D) The contractual relationship of the customer with the online shop is also regulated by the terms of delivery and the delivery charges. Where indicated, some of the online shops only deliver within their particular country or within Europe. Please check the forwarding terms of the online shops.
E) BPM Shop is not liable for any additional forwarding, export or customs clearance charges, regardless of whether these arise in the country of origin or in the country of delivery.
F) Should you require a solution for receiving and forwarding goods from/into the online countries, please check the services and contract terms of BPM Lux.
7) We reserve the right, at our sole discretion, to change, modify, or otherwise alter these terms and conditions at anytime.
Please review the terms and conditions periodically. Your continued use of site following the postings of changes and/or modifications will constitute your acceptance of the revised terms and conditions.
8) Responsibility for illegal activities.
Illegal activity (as determined by Luxembourg and European laws) is not permitted by BPM-Lux. Any legal fees incurred by BPM-Lux enforcing the applicable laws against a customer or potential customer will be the financial responsibility of the Customer.
9) Web-Server Service.
Customer expressly agrees that the use of the Web-server service is at Customer's sole risk. The Web-server service is provided on an “As it is” and “as available” basis. BPM-Lux makes no guarantee that the Web-server service will meet user's requirements, that the Web-server service will be uninterrupted, timely, secure, or error free. Customer understands and agrees that any material and/or data downloaded or otherwise obtained through the use of or from BPM-Lux Website and Web server is done at Customer's own discretion and risk and that Customer will be solely responsible for any damage resulting to Customer's computer system or loss of data that results from the download of such material and/or data.
10) Applicable Law and Competent Jurisdiction
The present agreement is subject to the law of Luxembourg .
Any litigation relating to the interpretation or the execution of the present agreement will be subject to the Courts of the City of Luxembourg .
